Disclaimer for Safenet

1. Introduction

This disclaimer (“Disclaimer”) is issued by the Safe Ecosystem Foundation, located in Zug, Switzerland (“Foundation”, “We”, or “Ours”), and applies to Safenet Beta as well as to all related information on our website and in other media channels (collectively referred to as “Safenet Beta”). If you are interested in Safenet Beta as a user or validator (“You”, “Your”, “Validator”, or “User”), please make sure to read this document thoroughly.

We reserve the right to change this Disclaimer at any time at our sole discretion. The Disclaimer in effect at the time you interact with Safenet Beta applies. It is your responsibility to periodically review the most current version of the Disclaimer. Your continued interaction with Safenet Beta constitutes your confirmation that you have carefully read and understood the content of this Disclaimer.

2. No Involvement of the Foundation in Safenet Beta Operations

Safenet Beta runs with a permissioned Validator set (“Beta Validator Set”) and focuses on core consensus related to transaction attestations, so called “Transaction Checks”. While the Foundation’s purpose includes supporting the development of the Safe technology, including Safenet Beta, the Foundation does not manage or control the Safenet Beta technology and does not provide you with any services related to Safenet Beta.

The Foundation is therefore not involved in the operation of any Validator, nor does it perform, supervise, or validate any Transaction Checks. Validators act independently, bear full responsibility for their activities, and carry out Transaction Checks exclusively on their own. The Foundation’s role is strictly limited to core technology development. In addition, the Foundation does not operate any interface to access Safenet Beta. By utilising or engaging with Safenet Beta, you acknowledge and agree that you are not engaging with the Foundation in any capacity.

Safenet Beta is still in a development and testing phase, i.e. provided on an “as is” and “as available” basis. Neither the Foundation nor any person associated with the Foundation makes any warranty or representation with respect to the completeness, security, reliability, quality, accuracy, or availability of the Safenet Beta technology, the results of any Validator Transaction Checks, or any services related to Safenet Beta. Without limiting the foregoing, neither the Foundation nor anyone associated with the Foundation guarantees that Safenet Beta will eliminate malicious transactions entirely. Any interaction with Safenet Beta is made AT YOUR OWN RISK.

3. Limitation of Liability

To the fullest extent permitted by law, in no event shall the Foundation, its affiliates, or its licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, Safenet Beta, including any direct, indirect, special, incidental, consequential, or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable.

You further understand and agree that neither Safenet Beta nor any of its implementations and/or components are under the control of and/or operated by the Foundation and that the Foundation shall not be liable for any loss or injury resulting from any vulnerability or any type of malfunction or failure of Safenet Beta, the results of any Validator Transaction Checks or any other issues resulting in loss or injury.

4. Governing Law and Jurisdiction

This Disclaimer shall be construed and interpreted in accordance with the substantive laws of Switzerland, excluding the Swiss conflict of law rules. The United Nations Convention for the International Sales of Goods is excluded.

Any dispute arising out of or in conjunction with this Disclaimer shall be submitted to the exclusive jurisdiction of the ordinary courts of the city of Zug, Switzerland.
